Terms and Conditions of Use Last updated April 23, 2021
By visiting The Quilted Jardin, LLC, you are consenting to the following legally binding terms and conditions. It is your responsibility to read these prior to purchase, use, or access to any of our products.
General Provisions: You must be at least eighteen years of age to make a purchase on our website. We host our site on a reputable platform and use trusted partners for various aspects of the business yet we make no explicit representations or warranties as to the safety of your individual use of the website.
Intellectual Property: This site contains intellectual property, including trademarks, copyrights, and other intellectual property, owned by The Quilted Jardin, LLC or the properly attributed party. It is illegal to use our property in whole or in part and as such could result in legal action (financial penalties and/or an injunction to stop immediately).
You may use our intellectual property with clear and obvious credit back to our site as well as links back to the page where the materials designs, images, text, quote or post is located.. However, you may never claim any of our intellectual property as your own or your unique creation, even with attribution. If you are uncertain whether what you would like to do is allowed, contact us at martha@thequiltedjardin.com.
Your Communications: Any communication made through “contact”, blog, newsletter sign-up, or other related pages or directly to our phones, mailing or email addresses is not held privileged or confidential and is subject to viewing by third parties.
We maintain the right to republish any submission, including photographs submitted for custom work, in whole or in part as reasonably necessary in the course of our business.
E-commerce: We offer products/services for sale on this site using WooCommerce. To avoid learning your credit card information, we’ve partnered with SQUARE to securely process payment. As such, we never learn or store your credit card information. We obtain the necessary information, including your name, email address, shipping address and information about your purchase from named third party vendors in order to provide our service to you. Alternatively, Payment for custom work can be made via personal check or an invoice we create using SQUARE. Full payment is required prior to initiation of any custom work, unless other arrangements are made during the initial discussion process (see Custom Work details below).
Shipping: Standard US Domestic Shipping is via USPS Priority Mail, which is estimated to take between 3 to 7 days travel time. You may also request an expedited method of shipping for an additional charge. Contact me at the time of your order if you desire that service. We are not responsible for misdelivered or undelivered packages if the shipping address given was incorrect. We are not responsible for delays caused by weather or transit once the package has been put into the USPS system. All US orders will have tracking and insurance.
Canadian orders: contact me directly first. If you are willing to get your own dowel for a wall hanging, the shipping cost is significantly reduced.
Other countries: contact me directly first to discuss the shipping process.
International Shipping which does not include tracking. You may also request an international expedited method of shipping for an additional charge. International orders cannot be tracked once the package leaves the U.S. It can take between 2-10 weeks to arrive at the destination and cannot be predicted. Please allow up to 10 weeks for delivery. If you need to upgrade to a tracking chippable method, please let me know. All duties and customs fees (these are added by your country) are the responsibility of the buyer. I cannot legally ship your package as a gift, so note you will need to pay these fees yourself. I cannot be held responsible for delays caused by weather, transit, or customs. Note: I do not ship art pieces framed under glass internationally.
Lost Packages: Please contact me immediately if you feel your item has been lost. I rely on USPS tracking to determine if a package is lost/missing. If your package is marked as delivered by the USPS, but is not received, please contact your local post office and check with neighbors, roommates, and/or family members. Speaking directly to your mail carrier may also be helpful. I am not responsible for items lost by USPS or after delivery.
Returns/Refunds: Returns are accepted on non-custom items ONLY. No returns on custom orders or personalized work. To request a refund, please contact me within 2 days of receiving the item and before returning it. The buyer is responsible for return shipping costs and assumes responsibility should the item go missing in transit. Once the item is received in acceptable condition, a refund for original cost will be processed. Returns will not be processed until the item is received.
Completed CUSTOM ITEMS or items that have been personalized are not returnable or refundable. I work closely with you throughout the process to create a piece you are happy with and provide you with multiple photos during the production process.
Important Note about Colors: Please note that colors might show up differently on various computers, phones or tablet screens. If you have questions about color accuracy of a particular part of your piece or want color matching, please get in touch. I’m happy to send out fabric swatches.
Broken or Damaged Items: Each item is packed carefully to make its way safely to you. Should you receive a damaged item, please contact me within 2 days of product receipt and we can work together to resolve the issue.
CUSTOM ORDERS: (more information is here)
Payment: Once the design of your work has been finalized, I will provide a quote. The point at which work will begin, you will receive an invoice for full payment. Payment can be made via credit card or a personal check. If other arrangements are necessary, these must be agreed to by both parties during the initial discussion process. The payment is 100% refundable if you contact us to cancel within 1 week of your payment date. Cancellation after that will be prorated with the current hourly rate for completed design and production hours.
Information/ Details Required: At least one clear reference photo is required for a custom order done from your photo. If the photo was taken by a professional photographer, I will need written permission from that person to use their photo as the reference photo for the piece.
Turnaround Time: Depending upon your custom project and my current production queue, turnaround time for custom work may be up to 6-8 weeks. If I anticipate that it will be longer than that, you will be informed at the time of initial discussion.
If this is a gift and/or needed by a specific deadline, please email me to be sure I can accommodate your due date. Rush orders can be done for an additional fee.
